During a Senate hearing on Wednesday, Senator Ted Cruz eviscerated Joe Biden’s Attorney General Merrick Garland, going so far as to accuse him of engaging in political affairs after he did not do any research and issued an “abusive” memorandum [1] telling the Department of Justice to investigate parents who have threatened school board members.
“There is a difference between law and politics, and General Garland, you know the difference between law and politics,” Cruz said to Garland, according to Fox News [2]. “Law is based on facts. It is impartial. It is not used as a tool of political retribution. This memo was not law. This memo was politics.”

Garland sent out the memo earlier this month in response to a letter from the National School Boards Association (NSBA) that claimed some parental behavior may amount to domestic terrorism. The NSBA has since apologized [4] for that letter, saying, “There was no justification for some of the language included in the letter.”
“In the letter, which you told the House of Representatives was the basis of this abusive memo, how many incidents are cited in that memo?” Cruz asked Garland, who replied, “I’d have to look back at the memo.”
Garland went on to say that he was not sure how many incidents were actually “violent.”
“You don’t know,” Cruz told him. “There’s a reason you don’t know. Because you didn’t care, and nobody in your office cared, to find out. … During this hearing, I counted 20 incidents cited. Of those 20, 15 on their face are non-violent.”

Not stopping there, Cruz accused Garland of trying to target conservative parents who have different views than him. The Republican senator also claimed that Garland labeled the father of the victim of a reported sexual assault at a school in Loudoun County, Virginia a domestic terrorist for protesting against the school’s handling of his daughter’s case.
“I never called him that. That’s not correct,” Garland stammered in response.
Garland was also grilled by Sen. Josh Hawley (R-MO), who questioned him about a memo issued by the U.S. Attorney for the District of Montana, which he said pointed to 13 federal crimes that parents could be prosecuted for if they speak up at federal school board meetings. Hawley pointed out that this list was seemingly designed to intimidate parents into not speaking up.
“You’ve testified today you’re focused on violence. That’s not what your U.S. attorneys — they work for you — that’s not what they’re saying. You haven’t seen it because it’s not a high enough priority or what?” Hawley asked.
“It’s not a question of priority,” Garland responded, outrageously claiming to have never seen the memo.
“What do you mean no one has sent you the memo,” an incredulous Hawley questioned. “You run the United States Department of Justice, do you not?”
