Federal prosecutors are pushing for Jacob Chansley, the Capitol rioter who has become known as the “QAnon Shaman,” to be given a sentence of 51 months in prison.

Prosecutors filed a memorandum on Tuesday in which they said that they “cannot overstate the seriousness of the defendant’s conduct as one of the most prominent figures of the historic riot on the Capitol.” On top of the over four years in prison, the government wants three years of supervised release and $2,000 restitution.

Chansley arguably became the face of the Capitol riot as he walked through the Capitol shirtless, wearing a hat with horns and his face painted red, white, and blue. Two months ago, he pleaded guilty to obstruction of an official proceeding, a charge that comes with a maximum of 20 years in prison.

Prosecutors have claimed that Chansley was one of the first 30 rioters to enter the Capitol at around 2:15 p.m., staying there until he was escorted out the east side around an hour later. He reportedly entered the Senate Gallery at roughly 2:52 p.m. and scaled the Senate dais.

“The defendant was among the first 30 rioters to penetrate the U.S. Capitol building,” they continued. “The defendant then stalked the hallowed halls of the building, riling up other members of the mob with his screaming obscenities about our nation’s lawmakers and flouting the ‘opportunity ‘to rid our government of those he has long considered to be traitors.”

“After the events of the day, the defendant gave multiple interviews to media in which he espoused his belief that he did nothing wrong,” prosecutors wrote. “The severity of his actions, and respect for the laws of this country, must be impressed upon him.”

Chansley is set to be sentenced in court next Wednesday, and his attorney has already filed a memorandum asking that he be sentenced only to the time he’s already served in jail. Since January, he has been in jail, and his lawyer claims that he has served more than 300 days in solitary confinement. The attorney also alleged that Chansley suffers from severe anxiety and panic attacks while locked away despite being nonviolent.

“It is time for the Shaman to start on his journey to freedom — not from jail, but from mental health infirmities of significance,” his lawyer said. “It is time for Mr. Chansley to commence his journey from within.”

Prosecutors, however, do not want Chansley to be shown any mercy.

“Chansley showed no remorse in the days after the event,” they wrote. “Gloating to NBC News that the actions of the rioters that day sent our nation’s lawmakers into hiding, with gas masks, retreating into their underground bunker.”
